Terms and conditions
- Scope and acceptance. These terms and conditions apply to all quotations, orders, invoices and deliveries issued by Light Caravan Factory (the "Factory") to its customer (the "Customer") and form an integral part of them. The Customer's acceptance or signature of a quotation or invoice, or payment of any amount under it, constitutes acceptance of all these terms and conditions, without the need for any separate approval.
- Prices and quotations. Prices are in Qatari riyals and exclude the vehicle, value added tax (where applicable), registration, insurance and government fees unless the quotation states otherwise. A quotation is valid only for the period stated in it. The Factory confirms the final specification and price before production starts.
- Payment schedule. The total contract value is paid in four payments according to the stages of the project, as follows: (1) first payment (down payment): 20% of the total contract value when the contract is approved and work begins, which confirms the order and reserves the delivery date; (2) second payment: 30% of the total contract value when the vehicle is handed over to the Factory; (3) third payment: 25% of the total contract value when the body has been mounted and the electrical connections and drainage works have been completed; (4) final payment: 25% of the total contract value when the final finishing works have been completed, and in any case before delivery.
- Commitment to the payment dates. The Customer shall pay each payment when it falls due, in accordance with the stages and percentages set out above. The Factory is not obliged to start any stage before receiving the payment due for it, and any late payment extends the delivery date by at least the length of the delay. No exception to this schedule is valid unless agreed by the Factory.
- Ownership and right of retention. The caravan body, its components and the works carried out remain the property of the Factory until the price is paid in full. The Factory may keep the vehicle and the caravan in its possession until all amounts due under the order have been paid.
- Handing over the vehicle. The Customer shall hand over the vehicle to the Factory, with its valid registration and ownership documents, at least seventy (70) days before the delivery date. If the vehicle is handed over late, the delivery date is reset to the next available production slot. The Customer guarantees that the vehicle is free of any lien or legal restriction, and the Factory is not liable for defects that existed in the vehicle before it was handed over.
- Cab modification and official approvals. Where fitting the caravan body requires modifying the cab, whether single or double cab, by cutting it or extending the chassis, the modification is carried out after obtaining the required legal approval from the Traffic Department. Any additional cost of cutting the cab or extending the chassis is not included in the quotation; the Factory informs the Customer of it, and where a fixed chassis-extension fee applies it is shown to the Customer before the order. Accepting the quotation or the invoice, or paying any instalment, constitutes the Customer's consent to this modification. The time taken by the authorities to issue the approval is added to the delivery date.
- Delivery dates. Delivery dates are set according to the Factory's production capacity and are estimates. They are binding only if confirmed by the Factory, and subject to the Customer meeting all its obligations under these terms and conditions.
- Force majeure and supply disruption. The Factory is not liable for any delay or failure to perform arising from events beyond its control, including, without limitation: the closure or disruption of shipping routes or sea passages, delays of shipments or materials, port congestion, customs procedures, war and hostilities, sanctions and export restrictions, epidemics, natural disasters, government decisions, and failures of suppliers or carriers. In such a case the delivery date is extended by the duration of the event plus a reasonable period to resume production, without any compensation. If the event continues for more than ninety (90) days, either party may terminate the order; the Factory then refunds the amounts paid after deducting the cost of materials purchased and works performed for the order, which are handed over to the Customer.
- Cost changes caused by force majeure. If the cost of imported materials or shipping rises materially because of an event described in the previous clause, the Factory may adjust the price by the amount of that increase. In that case the Customer may terminate the order, and the refund provisions of the previous clause apply.
- Collection. The Customer shall collect the caravan within fourteen (14) days of the Factory's notice that it is ready. If it is not collected within that period, a storage fee of fifty (50) Qatari riyals is due for each day of delay from the fifteenth day to the sixtieth day, and one thousand (1,000) Qatari riyals for each day of delay from the sixty-first day. If it is not collected within ninety (90) days of the notice, the Factory may remove the caravan body from the vehicle, hand the vehicle back to the Customer in its condition after removal, and dispose of the body, including fitting it to another vehicle, without any refund of the amounts paid and without prejudice to the storage fees due. The Factory is not obliged to restore the vehicle to its original condition.
- Cancellation by the Customer. The Customer may cancel the order within sixty (60) days of the order date. In that case 20% of the amount paid is deducted and the balance is refunded within forty-five (45) days of the cancellation request. The order may not be cancelled after sixty (60) days from the order date, and in that case the amounts paid are not refundable.
- Changes to the order. No change may be made to the order after manufacturing has started. Any change requested before that must be made by a formal letter signed by the Customer and takes effect only once the Factory approves it; it may change the price and the delivery date.
- Inspection at delivery. The Customer shall inspect the caravan at delivery and sign the delivery note. Any visible defect must be recorded on the delivery note; otherwise the caravan is deemed accepted in good condition.
- Warranty and after-sales service. The warranty is governed by the warranty certificate issued at delivery. It does not cover misuse, accidents, normal wear, or modifications made by others, nor the vehicle itself, which remains covered by its manufacturer's warranty.
- Limitation of liability. To the extent permitted by law, the Factory's total liability for any order shall not exceed the amount paid for the caravan works under that order, and the Factory is not liable for indirect or consequential loss, including loss of use or profit.
- Personal data. The Customer's personal data is processed in accordance with the Factory's privacy policy and Qatar's Personal Data Privacy Protection Law (Law No. 13 of 2016).
- Governing law and disputes. These terms and conditions are governed by and construed in accordance with the laws of the State of Qatar. The parties will seek to settle any dispute amicably; failing that, the courts of the State of Qatar have jurisdiction.
- Publication, amendment and language. These terms and conditions are published on the Light Caravan website, and the Factory may amend them at any time. Amendments take effect from their publication on the website. A customer with an existing order may object to an amendment within fourteen (14) days of its publication, in which case the version in force on the order date continues to apply to that order. If the Arabic and English texts differ, the Arabic text prevails.
These terms are part of every quotation, order and invoice. Questions: info@lightcaravan.com.
